Default Delta moving coach passengers to business due to overbooking in Europe?

I was talking to a Delta pilot today and he said he'd heard that, due to a passenger's rights bill passed in Europe, Delta was upgrading coach passengers to business class to avoid fines. Allegedly this is leaving a lot of non revvers high and dry?

Has anyone else heard about this?

well, my husband flies EU all the time and it's never been mentioned. I monitor flights and I haven't seen evidence. Why would that leave more nonrevs? If they upgrade anyone for any reason, that leaves a seat in coach...
I have no idea what sort of pax rights would merit an upgrade to business. I work with several travel forums and I've never heard of it.
Currently, US carriers aren't bound by the Eu BOR but it seems they are wanting to change that. I doubt it will happen.

Hopefully it was just a pilot spreading a rumor. I'd hate to be stuck in Europe.

Hey Mrs. which would you rather fly out of to get back to the states? AMS or CDG?

    AMS for me as well.

More options and a cheaper departure tax.

if coach is oversold and there's seats available in first class/business, they will upgrade coach passengers into first class/business. Doesn't really have a net effect on nonrevvers.

yep--tough weekend in AMS. the major vacation wk for all of Germany. Had friends trying 3 days from Bremen, '98 seniority, S3B and S4.. They got out yesterday.
Lists for all 13 DL flights to US were 30-40 nonrevs long. Lots of HK's in Dusseldorf and FRA and BRU, too.
    Heavy loads all over EU.
I'm going to try for DUB 48 hr, then Rome week after--WISH ME LUCK!

WOW--they DIDN"T get out yesterday. Hoping they make it to MSP but it isn't looking very good. loads are horrendous!

I'm pretty sure I won't chance DUB since I'd have to buy zed to AMS--HA!! or stay overnight somewhere...YUK CDG ? Patooey

That wont happen on international flight. Not without them paying a fee. I have been sitting in LHR and got on in Business class, when stand-by passengers were still sitting at the gate.
